Thursday 06/05/2025 at approximatley 2140 hrs Deputy Howard # 547 was dispatched to a verbal domestic at [10 BLOCK] Pioneer Court. I, Sgt. Blaylock, was in the vicinity and responded code one due to dispatch advising parties were seperated; caller would be a [WITNESS #1] subject and the offender would be a Francisco subject. I was also advised there was a language barrier. I arrived on scene and was met by a hispancic male who I ascertained was the caller, [WITNESS #1]. Also, a second subject was outside as well and appeared to be heavily intoxicated. I pointed to the second male and asked [WITNESS #1] if he was Francisco and he indicated yes.
I had dispatch connect me with the language line and had the translator gather details on what had transpired. According to [WITNESS #1] he was sleeping and four of his roommates woke him up and told him he needed to do something with Francisco because once again he came home very intoxicated and was harassing them. I did observe four other hispanic males sitting ourside to the left of the residence playing cards. [WITNESS #1] stated his other roommates told him if he didn’t call the police and get Francisco removed they would have to “fight him”. [WITNESS #1] stated he wanted Franciso out of the house because he is always drunk and causing trouble. At this time Deputy Healey # 541 arrived on scence and we then had the language line attempt to speak with Franciso however each time I held the phone up to him for the translater to ask questions he would just start talking. Finally, I was able to gather Francisco just wanted to go to bed and when asked how much he had to drink he stated some.
Myself and Deputy Healey asked if Franciso had an I.D on him. He attempted to enter the residence and continued after he was told no. Deputy Healey had to pull him from the front door and back down the steps holding on to him so he did not stumble and fall. I asked [WITNESS #1] to look inside the residence for an I.D. for Franciso. At this time Francisco kept trying to say his name was Alex. [WITNESS #1] returned and stated he could not find a wallet for Francisco. I asked [WITNESS #1] why Francisco is saying he is Alex. [WITNESS #1] said he knows him as Francisco but some people call him Alex. It should be noted that he told the detention officer during booking his name was Roberto Garcia.
Deputy Howard arrived on scene and I explained what had transpired and that Francisco had no other place to go, he was heavily intoxicated and was causing trouble with the other subjects on scene outside the residence. Knowing he could not be left at the scene due to threats of violence Deputy Howard placed Francisco under arrest in violation of County Ordinance 31-1 Disorderly Conduct with a court date of 07/18/2025. Deputy Howard transported Francisco/Alex/Roberto to the Gilmer Detention Center. Beginning/ending milage given to dispatch as well as a rear seat contraband check after leaving.
I had the translator explain to [WITNESS #1] he cannot just kick Francisco out of the residence and had her explain the eviction process. He said he would go the following morning. I told him to ask at the front desk for a translator and they could walk him through the process. I gave him a victim pamphlet with this case number and stated he should take this with him to the court house.
