On 09/06/25 around 0008 hrs. I (Cpl. White) along with Cpl. Weaver responded to the incident location in reference to a harassment call for service. I responded non emergency. When we arrived I activated my bodycamera as well as the audio/video for car #724. As we approached the residence of [30 BLOCK] Yukon Ct. I was able to observe off in the distance at a residence beside [30 BLOCK] Yukon Ct. a male subject later identified as offender (Dakota Abernathy). Dakota was observed to be yelling out loud and cursing towards Cpl. Weaver and I.
During this time I observed a group of approximately five people walking from around the corner of another residence close by at [50 BLOCK] Yukon Ct. The subjects later identified as [WITNESS #1], Jody Fowler, Adam Fowler and another subject would could not be identified before he left the scene. These subjects first appeared to have been drinking alcoholic beverages due to the smell of an alcoholic beverage coming from the “group” as well as obsevering their behavior, mannerisms as well as their overall appearance.
With Dakota already yelling in a very aggressive manner and appearing to be intoxicated himself and the number of people walking towards us I requested additional units for backup. We began speaking to the group and after they identified themselves they began to explain that Dakota lived at the residence he was at standing on the front porch at the moment ([50 BLOCK] Yukon Ct.). Jody, [WITNESS #1], [WITNESS #1]’s girlfriend and Adam Fowler all lived at [50 BLOCK] Yukon Ct. along with Jody’s son and his wife (who was not identified until later due to staying inside of the residence).
Jody, Adam and [WITNESS #1] began to explain that Dakota and his wife [WITNESS #2] pulled into the residence at a high rate of speed, slamming doors, yelling and it appeared that they had been drinking or at least Dakota had been. Dakota began to continue to drink, yell and curse out into the open area very loudly. Jody stated that they were inside of their residence and the noise that Dakota was making was disturbing to the point that it woke up his baby.
[WITNESS #1] advised that he stepped outside at the beginning to ask if Dakota could stop yelling and making so much noise. [WITNESS #1] advised that Dakota refused and continued to yell and curse more. Jody stated he and Adam went over to Dakota’s residence, which was directly behind Jody’s residence approximately 30 to 40 feet. They explained that Jody again told Dakota that his child had been woken up and Dakota was being very loud and disrespectful. They advised that Dakota then threw a beer in Jody’s face and instinctively Jody stated that he pushed Dakot away from him.
At this time I did observe the shirt that Jody was wearing appeared to be covered in a liquid and wet. I could not observe at that time if there was an odor of an alcoholic beverage on the actual shirt or not due to the overall smell of the group. Jody stated that after he got Dakota away they walked back over to their residence and stated that’s when Dakota called “the cops”. Jody and Adam did advise that during the altercation they believed that [WITNESS #2] got pushed by Dakota.
Due to being able to physically see Dakota before speaking to him we waited on additional units to arrive. Once additional units arrived we walked over to speak to Dakota. While speaking to Dakota he continously was yelling, cursing, behaving disorderly and eventually he began to lower his voice some to speak to us. I was able to observe that standing with Dakota was his wife [WITNESS #2], Dakota’s mother [REDACTED] and another male subject [WITNESS #3].
Dakota stated that he was standing on his property “minding his own business” when Jody and Adam came over to his residence acting aggressive. Dakota explained that at first he did not know who hit him, but later advised that he believed Jody hit him. I could see a small red mark however, it was not something that I could state was fresh or could be identified as being something that stood out as evidence in this incident.
I was also able to speak to [WITNESS #2]. She advised that Jody and Adam did come over to the residence. She advised that she told Dakota to be quiet and calm down and “knew this was going to happen” referring to Dakota being loud and unruly. [WITNESS #2] advised that she attempted to get inbetween both Jody and Dakota and when asked she stated that Dakota did attempt to move her out of the way, but she did not believe she was pushed intentially. She added that when Jody hit Dakota, Adam then hit [WITNESS #3].
While speaking to Dakota he requested to be checked out by EMS. Sgt. Blaylock then requested EMS to be en route. I spoke to [WITNESS #3] and he advised that he did not need medical attention, but stated that yes he was hit by someone, but he did not know who. Deputy Healy began to get witness statements from all parties involved that he could. EMS arrived and began to take a look at Dakota.
During this time I walked back to Jody’s residence and spoke with [WITNESS #1]’s girlfriend. She advised that she was able to observe the incident and stated that Jody and Adam never hit Dakota and “the other guy”. After collecting the statements I explained to Jody and Adam that they would be put down as suspects in this incident and that the decision not to arrest them was being based soley on not having enough supportive evidence and that this was a situation of one party stating the exact opposite as the other party. Victim’s pamphlet was left at the scene.
EMS advised that Dakota refused to be transported for medical treatment and was signing a release. Shortly after Dakota was advised he was being placed under arrest for the county ordiance of disorderly conduct. Deputy Healy and Deputy Howard assisted in placing handcuffs on Dakota in the rear, double locking them and checking for proper fit. Dakota was secured in Deputy Healy’s patrol vehicle and transported to the Gilmer County Detention Center without incident and turned over to the jail staff.
